14 Years of Law Offices of Ellen L. Lee | Divorce And Family Lawyer | Rockville, MD | Call 301-279-0692

Betty W.

“Ellen has been my attorney for 14 years. She did everything from custody to child support. Back then, all I did was cry “sorry, Ellen!”. Ellen fought hard for me, even when I was ready to give in. Year after year, Ellen was there. It got to the point where her continued presence dismayed my opponent. If you want a lawyer to hug you – that’s not Ellen. If you want someone who will win for you efficiently for a fair price – HIRE Ellen, do your part, take her advice, and you won’t regret it.”

Former Client

“Ms. Lee handled my divorce a few years ago and I remembered how she was thorough in her diligence and also made me feel like a valued individual. So when I had a child support & custody case, I re-engaged Ms. Lee. Again, she treated me as a person, not a case. She advised me on the merits and realities of my case, so I didn’t feel as if I were being “sold” a bag of services. Ellen is eloquent and personable, which is a winning combination for an attorney.”

Types of Alimony in Maryland

The state of Maryland requires that a custody arrangement provide for both physical and legal custody of the child(ren). The parent with physical custody provides a home for the child and makes the day-to-day decisions on the child’s behalf. On the other hand, legal custody refers to the right to make the big life decisions concerning the child, such as those dealing with education, religion, and medical care.

Temporary Alimony

Also known as pendente lite alimony, temporary alimony is available only while your divorce case remains open. Once your divorce becomes final, the amount of spousal support may change or stop altogether, depending on the terms of the divorce order.

Rehabilitative Alimony

Rehabilitative alimony begins when the divorce becomes final and lasts for a finite period of time. The purpose is to give the spouse who needs support a reasonable time to become financially independent.

Indefinite Alimony

Indefinite alimony is rarely granted with two notable exceptions:

1. If your age, health, or disability status makes you incapable of becoming self-supporting;

2. If you have made genuine efforts to become self-supporting, yet the relative standard of living of you and your spouse remains extremely lopsided, generally 3:1 or 4:1 difference in quality.

Courts rarely order indefinite spousal support. Most often, rehabilitative alimony is granted. At the Law Offices of Ellen L. Lee in Rockville, our alimony attorney can advise you about which type of support, if any, is likely to apply to your situation.

How Is Spousal Support Decided In Maryland?

Rockville courts and those throughout Maryland consider a number of factors when they decide whether a spouse should receive alimony, and if so, how much.

These factors include:

  1. Your ability to support yourself
  2. Your level of education
  3. Your need for additional education or training
  4. The standard of living during your marriage
  5. Length of your marriage
  6. Incomes of both spouses
  7. The age, physical, and mental health of both spouses

Additional factors may affect the alimony award in your case. The People’s Law Library of Maryland has developed an estimation resource. Regardless, you will need an experienced lawyer to negotiate the appropriate level of spousal support. Our Rockville spousal support lawyer can represent those seeking as well as contesting alimony. If negotiation doesn’t work, we can argue your position before the court.
